1. Scope and provider
These terms apply to the Fjord website, dashboard, interfaces and Discord bot. The provider is Peter Gnädig, Klappschau 0, 24837 Schleswig, Germany. You can contact us at fjordbot.contact@gmail.com.
These terms form part of a service agreement only when validly incorporated and agreed to. Merely visiting the website does not constitute agreement. Individual agreements and mandatory statutory rights take precedence over these terms.
2. Service and access
Fjord is provided free of charge and offers welcomes, cards, AutoMod, moderation, activity logs, embeds, roles and access settings for Discord servers. There is no minimum term or automatic conversion to a paid service. Changes are governed by section 14.
You must meet Discord’s minimum age applicable to you and the legal requirements. Where a valid contract requires your legal representative’s consent, you need that consent. Anyone acting for a server or organisation must have the necessary authority.
3. Discord account and permissions
Protected functions require Discord sign-in. You may administer only servers for which you hold the required permissions and must not share sessions with unauthorised persons. Report suspected unauthorised access to fjordbot.contact@gmail.com. Fjord is an independent service, not a Discord offering. Our own statutory duties remain unaffected.
4. Right to use Fjord
For the permitted period of use, you receive a non-exclusive, non-transferable right to use the service as intended. Ownership of software, source code, design or trademarks is not transferred. Mandatory statutory entitlements and rights under applicable open-source or other separate licences remain unaffected.
5. User content
You must hold the necessary rights to submitted texts, links, images, embeds and other content. Observe copyright, personality, data-protection and youth-protection law. Server operators must ensure the necessary information and legal bases for their processing of member data. This does not transfer the provider’s own duties to you.
You grant us non-exclusive permission to store, technically process, display and transmit your content to Discord only as necessary for the requested service. Service providers we engage may process content only for this purpose. Ownership remains with the rights holders. Independent commercial exploitation of your content is not authorised.
After termination, this permission ends except where lawful retention, backup or winding up is necessary. Statutory restrictions on further use and rights to obtain content remain unaffected. Where required by law, we provide content on request free of charge in a common machine-readable format within a reasonable time.
6. Permitted and prohibited use
Unlawful content, harassment, threats, deception, spam, malware, unauthorised access, bypassing security or permission checks, deliberate overload and violations of applicable Discord rules or third-party rights are prohibited.
Without appropriate permission, you may not copy, resell, rent out or offer Fjord as your own service. Reverse engineering and decompilation must not violate applicable law or licences. Statutorily permitted acts and separate licence rights remain permitted. Report vulnerabilities to fjordbot.contact@gmail.com. Testing requires our permission unless already permitted by law.
7. AutoMod and moderation
Server administrators determine AutoMod, logging and moderation rules and are responsible for their lawful, transparent and proportionate configuration. Automated measures may delete messages, issue warnings, impose timeouts or trigger other configured actions. Fjord provides the tools and does not undertake the ongoing moderation of the respective server.
Automated detection can be wrong. Review rules and justified complaints and correct mistaken decisions where possible. A moderation record stored by Fjord does not automatically establish an infringement. Our own statutory review, protection and action duties remain in force.
8. Discord and external services
Fjord depends on Discord and infrastructure services. Their outages, changes or restrictions may affect functions. External services have their own terms of use. We do not fully control their decisions. This does not exclude our own responsibility or responsibility for service providers attributable to us by law.
9. Suspension and termination
Where there are concrete indications of abuse, security risks, infringements, missing permissions or material breaches, we may proportionately restrict affected access, content or functions. We consider severity, repetition and suitable less restrictive measures. Permanent bans and termination for cause require correspondingly serious grounds. Urgent risks may require immediate action.
Where legally permitted and without jeopardising an investigation or security, we inform you of the measure and its main reasons. You may request review at fjordbot.contact@gmail.com and submit information in your defence. Unfounded or no longer necessary restrictions will be lifted. Statutory complaint and legal remedy rights remain unaffected.
You may stop using the service at any time and terminate the service agreement via fjordbot.contact@gmail.com. Server operators may remove the bot. Simply signing out does not automatically terminate the agreement or delete all data. Storage and deletion follow the privacy policy and statutory duties. Ordinary termination by us requires reasonable advance notice. Statutory rights to immediate termination remain in force.
10. Availability and maintenance
We promise no specific uptime percentage or uninterrupted use. Maintenance, technical faults and external service failures may cause interruptions. Applicable statutory performance, security and update duties and defect remedies remain in force even for free use. Backups reduce risks but do not guarantee complete or immediate recovery.
11. Warranty and liability
Statutory defect remedies are not excluded. We have unlimited liability for intent and gross negligence, culpable injury to life, body or health, fraudulent concealment, assumed guarantees and other mandatory liability, particularly under the German Product Liability Act. This also applies to corresponding breaches by our legal representatives and persons engaged to perform our obligations.
For slightly negligent breaches of essential contractual duties, liability is limited, where legally permitted, to foreseeable damage typical of the contract. Essential duties are those enabling proper performance of the contract and on whose observance you may ordinarily rely. Unlimited liability under the preceding paragraph and other mandatory rights are not limited by this. Otherwise, statutory provisions apply.
12. User responsibility
Under statutory rules, you are liable for damage and justified third-party claims culpably caused by unlawful use or breach of contract. There is no blanket duty to indemnify regardless of fault. Our own share of responsibility and statutory defences are taken into account.
13. Notices and complaints
Report complaints, suspected unlawful content and infringements to fjordbot.contact@gmail.com. Describe the facts and, where available, affected content, links or server and message IDs, and how to contact you. We review reports and respond as needed to process them. Sign-in is not required. Missing details do not exclude statutory rights.
14. Changes
Objective reasons for necessary feature changes are adapting to changed Discord interfaces, fixing vulnerabilities and meeting new legal requirements. Changes must be necessary and reasonable and must not create additional costs. We clearly explain changes. Where required by law, we give reasonable advance notice on a durable medium of their nature, timing and termination rights. Statutory rights, particularly under section 327r of the German Civil Code, remain unaffected.
Where section 327r of the German Civil Code applies, you may terminate free of charge within 30 days if access or usability is impaired more than insignificantly. The period starts on receipt of the required information or on the later change. This special right does not apply if the unchanged service remains accessible and usable at no additional cost.
Publishing a new version of these terms does not by itself amend existing agreements. Contract changes require a valid agreement unless a statutory basis permits the change. Silence and mere continued use do not constitute consent. A paid offering always requires a separate express agreement. Changes do not apply retroactively.
15. Governing law and dispute resolution
German law applies. If you are a consumer, mandatory protections of the country of your habitual residence remain applicable where the statutory conditions are met. No exclusive court jurisdiction is agreed with consumers. Statutory jurisdiction and access to courts remain unaffected.
The provider is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration body. This statement limits neither statutory claims nor judicial remedies.
16. General provisions and languages
Invalid provisions are subject to the statutory consequences, particularly section 306 of the German Civil Code. An invalid clause is not automatically replaced with the closest permissible economic equivalent. All language versions are intended to convey the same substantive rules. No language has blanket precedence. Discrepancies are governed by statutory interpretation rules, including protection against unclear standard terms.
17. Data protection
Information about data processing, retention periods, active backups and data-subject rights is available in the Privacy policy. Agreement to these terms is not blanket consent to data processing. These terms do not replace required separate consents or data-processing agreements.
